Many years ago I was rideing with a older guy. He parked on a narrow street, swung the drivers door open and a kid rideing a bike fast hit the door. I really felt sorry for the kid as he laid in pain with by buddy bawling him out!

In that case, your buddy was wrong and should've been cited for failure to be cognizant of his surroundings. I am a cyclist and when riding in town must be in constant watch for fools like him. If the door is thrown open in my path and I can't avoid it, I suffer the physical consequences. That person, however, will suffer the legal ramifications of his thoughtless action.

UhOh, we got us a discussion coming up Cyclists are a plague and should be constrained to the sidewalk. They can't keep up, yet impose themselves in the flow of traffic and cause a hundred times the problems they themselves incure.....Legally, you might be correct, but common sense should tell you to keep the heck out of the way....**off soapbox**

WHAT!!? Real cyclists do not ride on the sidewalks. I have no problem keeping up with traffic, chemotherapy depleted body notwithstanding. I remain aware of potential traffic hazards, but have little control over stop sign and red light runners. After being hit one time by an ignorant driver, I remain extra vigilant for any motor vehicle operation that can cause me harm, door openers included. Those that may cause me grief for other reasons must beware the .45ACP that resides legally in my bike bag, or on my person.

Oh, great....another Kalipornia Cycle Anarchist In Seattle (Little Kali ) the Cycle Gangs will do a rolling blockade once a month and key or otherwise screw up/threaten drivers if they are so bold as to think they should be going more than 10 or 15 in a 35 zone.......PITAs, every last one of ya

I AM DEFINITELY NOT AMONG THOSE FOOLS, TUBBY!! I may be a PITA to some drivers, but that is certainly not my intention. I just like to hit the road for pleasure and exercise. I feel good if I can do 20 miles at an average 18 mph, including stopping at all required locations. Those that don't even slow for stop signs and red lights deserve to be slammed and have no legal recourse if that happens.

Common sense would say you are correct, sadly that is not always the case. Last year here in town, a young woman on a bicycle ran a red light. She was struck by a car driven by a woman who broke no law and did nothing wrong. The bicyclist sued her and won a settlement of several hundred thousand dollars.
YIKES!! I fail to understand how that can happen, all things considered. I have many friends both in LE and the Courts, who have told me that what happened in just such a case is WRONG. The judgement should have been taken to a higher authority and overturned. The cyclist broke the law, not the driver.

There was a big stink made by local radio and such at the judgement at the time. Not sure if anything more ever came of it. The idiot jury believed the driver of the automobile should have been paying more attention to her surroundings and saw the bicycist coming.
