Getting Sued
Four years back we received some firearms for a transfer. Guy shows up sometime later and tells me they are for him. He has only a driver's license that expired several years before that. I don't do the transfer, he starts to get more and more hostile as time goes on - we find him in the neighbor's yard watching our house, he sends a letter threatening that if I do not give him the guns, my wife or children may get hurt or killed, we start finding cigaret butts outside the kids window in the mornings - which actually motivated us to move to a different location.
Now he is bringing a lawsuit against me, taking all of the time I need to be working and costing a lot of money.
For those of you who are the praying type, we could use some prayers.

Bad deal. Did you do an abandonment on the guns or send them back? What is he suing for?

I don't see what kind of case he can possibly stand on.
The threats will be hearsay unless you have witnesses, recordings, or better yet, DNA evidence from all the stuff he left on your window. Assuming you don't have any of that, it shouldn't matter. No ID, no xfer. Heck even I ran into that. Forgot to update my address and the guy apologized politely and said I'd need to get an ID with my current one on it. I did and was back the next day, no fuss no muss.
So this guy hasn't been able to produce a legitimate ID in all this time? Really? How is he hiring a lawyer? Something's really off about this IMO. Lawyer up, don't talk to him and record every contact he makes with you. I don't know what the wiretap laws are in your state, but look those up too. Two words: "Counter-sue" if only for time and wages lost.

Unfortunately you don't need much at all for a scumbag to bring a suit against you even just to waste your time and money. But good luck trying to bring a counter suit against that individual. Our legal system is bias to the wrong parties. Much of the advice already giving is good. Document all contacts as much as possible and it might even be a good idea to hire a Private Investigator to find out who this person is. Knowing your "enemy" is the first step in defeating them.

Doesn't matter if he can win or if he has little chance - he can still cost me a ton of money and time. His purpose from the beginning was to take it to court. A lot of the background (threats, etc.) I posted does not really apply to the actual lawsuit.
I will post more details once it is over, as well as the end result.

That's for sure. Happened to me a couple times as a small business owner.
Good luck and don't do anything stupid. Emotions can really get some people in trouble.
I remember my attorney grabbing my arm so hard during my divorce he actually left a bruise, he could see hat I was about to blow. But the tough old guy was right and I got what I wanted.

If you have a good friend who is a cop, there's something to be said for a "visit" by an officer, who makes it known that if you so much as get pee on your leg someday when you take a leak outside in the woods, that Mr. Scumbag is going to be numero uno on the list of 'causes' to investigate.

What's the basis for the suit? You seem to have acted according to the Law. No valid picture I.D., no gun. I've been turned down for cashing a check because my D.L. had expired. Get a nasty lawyer and counter-sue for a frivilious lawsuit!

Exactly my thoughts. I could not imagine having to move because of others people's threats.
Now,there are TWO things going on.........the "transfer issue" and the "threat to the family issue". There appears to be more to this story.
If someone threatens you or your family with bodily injury, you don't need any evidence......you call the cops........pronto.............don't forget........calling the cops and making a report is FREE.

with a real lawyer you can probably get a suit dropped as frivolous, and ask for your costs at the time the suit is dropped.
also, get an injunction against trespass. he has already committed illegal trespass.
and make it known that you consider the perp a mortal threat due to his hate-crime activities and the threat to your family. maybe take out a newspaper ad to that effect.
and GATHER PHYSICAL EVIDENCE including trail cam photos.
and find out if you can legally record conversation with one party's knowledge. you can in Alaska. And that stopped just such a scumbag in his tracks.

I hate people who abuse the legal system. It is why I am so slow to engage in it even with just cause.
Hopefully this turns around to bite the ba$tard. Hope you kept the threatening letter. I have to hand it to you for your patience. If someone threatened my wife and kids, they would disappear quite quickly...

Prayers sent. Now, if someone comes in to my yard and hangs out watching a neighbor, well, he will deserve what my 14 year old Boxer/Shepherd mix does to him. I am not threatening anyone, but a good dog knows when someone is in the wrong territory for bad reasons.

Buy a mouthpiece & take the professional advice you pay for. Forget all the buffonery & ridiculous, amateur suggestions you're getting here. It is improvident to seek professonal legal advice from total strangers on the internet. Would you seek brain surgery advice from these same strangers?

That would really impress a jury asked to judge which of you was nuts. You're already fighting an uphill battle as a purveyor of black, evil firearms in an era of child deaths.

Well let's be accurate shall we? He wasn't seeking legal advice, just simple prayer and support - which he's gotten in droves. Add mine.
