Re: HUGE 2A Win
In keeping with Heller, we hold that when the Second Amendment’s plain text covers an individual’s conduct, the Constitution presumptively protects that conduct.
To confine the right to “bear” arms to the home would nullify half of the Second Amendment’s operative protections. Moreover, confining the right to “bear” arms to the home would make little sense given that self-defense is “the central component of the [Second Amendment] right itself.”
Heller, 554 U. S., at 599; see also McDonald, 561 U. S., at 767. After all, the Second Amendment guarantees an “individual right to possess and carry weapons in case of confrontation,” Heller, 554 U. S., at 592, and confrontation can surely take place outside the home.
Although we remarked in Heller that the need for armed self-defense is perhaps “most acute” in the home, id., at 628, we did not suggest that the need was insignificant elsewhere. Many Americans hazard greater danger outside the home than in it. See Moore v. Madigan, 702 F. 3d 933, 937
(CA7 2012) (“[A] Chicagoan is a good deal more likely to be attacked on a sidewalk in a rough neighborhood than in his apartment on the 35th floor of the Park Tower”). The text of the Second Amendment reflects that reality. The Second Amendment’s plain text thus presumptively guarantees petitioners Koch and Nash a right to “bear” arms in public for self-defense.

it's a shame he specified "handgun", but he is a heroic patriot

Re: HUGE 2A Win
They have to decide cases on what facts are presented. This case was about New York's handgun permitting law.
Re: HUGE 2A Win
Mind you, I am VERY happy about that ruling. HOWEVER, the second amendment says in part THE RIGHT OF THE PEOPLE TO KEEP AND BARE ARMS "SHALL NOT BE INFRINGED"! They have been infringing on that right for about a hundred years or more! WHEN IS ENOUGH ENOUGH!!! I mean why not exercise a right and NOT ask for a privilege which is what you do when you apply for a carry permit!

Thanks for the reminder. We sometimes forget that point.Scott Tschirhart wrote: ↑Thu Jun 23, 2022 1:39 pm They have to decide cases on what facts are presented. This case was about New York's handgun permitting law.

I agree Scott, but those little nuances are the gallows our liberty is hung from....

Re: HUGE 2A Win
I think this is how to look at it. It is a big win as it clearly establishes the 2nd Amendment as the right for us to carry pistols for self defense and none of this hunting bull Pelosi.
It still allows local and state governments to set aside prohibited special areas.
It still allows for permits, and the permit requirements will be the next fight. I would much rather that they would have said that the States had no right to "permit" the carrying of a pistol. But we have a Justice who just would not go along.
Re: HUGE 2A Win
The response by the NY Governor was interesting when she mentioned that the 2nd Amendment was from the era of muskets and she would gladly go back to muskets. Plus, the founding fathers did not envision assault rifles and hi cap mags........ If she uses that analogy, would she be willing to trade in her laptop, cell phone, etc and go back to a quill pen??? She most definitely would not (!) and would consider such an infringement and attack on her 1st Amendment rights! Silly goose.

How will this decision affect the people in the state of Md. We gotta jump through a bunch of hoops to a ccw. One of the requirements is that you have to handle cash for a business in the amount of 1500.00 bucks or more and have to get the business to write a letter stating so for the business. I already have my hgl permit to buy handguns.

Re: HUGE 2A Win
.
I'd love to see what the NYC Mayor and NY Governor would think about a law that says you can't Speak Out about a political issue (like, say.... gay rights, or climate change), except within your own home, unless you demonstrate 'special need' to exercise your First Amendment rights, and take a special speaking and writing course that costs a bunch of money...

I think the state legislature is going to have to revisit those requirements or there will be a Court that changes it for them.rossim92 wrote: ↑Fri Jun 24, 2022 8:14 am How will this decision affect the people in the state of Md.
