"Mastermind" of DC Gun Case to appear on Gun Talk Radio

Alan Gura, the Washington, DC, attorney who has been called the "mastermind" of the Heller case -- the landmark decision which has overturned the long-standing gun ban in the nation's capital -- will be the featured guest this Sunday, March 9th on the national radio talk show "Tom Gresham's Gun Talk."

Gura is the lead counsel for Mr. Heller and will argue the case before the Supreme Court on March 18. The federal appeals court ruled that a gun ban in the nation's capital violated the Second Amendment rights of citizens there, and that decision was appealed by the city to the Supreme Court.

"This is the most important court case for gun rights since the 1939 Miller decision," said Tom Gresham, host of the nationally-syndicated radio program. "It just may be the biggest decision in the history of the Second Amendment. Constitutional scholarship on this amendment has been evolving rapidly over the last 20 years, and many who follow this issue think we have reached a perfect storm of public sentiment, published law journal articles, the makeup of the Supreme Court, and a possible upcoming shift in the Presidential administration away from respecting the rights of the 90 million gun owners in the United States."

Gura will join Gresham for a lengthy discussion of the case -- how it came about, how the media is covering it, and a look at the possible outcomes and what they might mean. The national media has covered this more than any firearms issue since the passage of the Gun Control Act of 1968, with widely-divergent views coming from many sides.

The U.S. Solicitor General filed an amicus brief some have called convoluted, which supported the rights of individuals to own guns, but which called for the Supreme Court to retain the DC gun ban. This action generated widespread negative reaction among gun owners, who believe they were responsible for President Bush's election victory.

On the other hand, a majority in Congress signed a brief on the case supporting the Appeals Court decision to overturn the ban.

"Even if the court delivers a narrow ruling, as some observers expect," said Gresham, "as long as it upholds the decision to overturn the ban, it starts the process moving. Gun owners who have seen their rights stripped away over the last 69 years, through the passage of more than 20,000 gun control laws, are saying it is time to take back those lost rights. This could well be the beginning of a new civil rights movement."

Thanks. I wish he had gone on longer but he got in some good detail. Interesting points about using the Commerce Clause to regulate but should not be able to ban, etc.
