there is a simple legal principle in any altercation. if somebody starts at a low level of irritant, such as a verbal insult, they are wrong at that point, and the "insultee" is a victim. But if the other party raises the bar to a slap, shove, punch, bite, etc, the party who makes it physical is at that point the aggressor, and is in fact the attacker, and our orignal "aggresor" is now the victim. (you can meet force with force, but you cannot up the ante).
Further, if you were to reach into somebody's car and grab hold of em, and ya happen to be in a state with an "extended castle doctrine", they MIGHT be in the right to shoot you EVEN IF they initially swore at ya, etc. Being insulted does NOT give us carte blanche to kick some tail and claim "victim" status and impunity for physically punishing the insultor. (though we might like that).....
If it had stopped at the lady slapping the rude mouth, he woulda been guilty of harassment, and she of simple assault. Once her Marine husband grabbed the guy, a case MIGHT well be made the guy was in fear of his life and responded justifiably, even though his mouth started it.
True, and the folks typically winding up drafted for, and accepting, Jury Duty, will not have a good grasp of relative lethality of weapons.
