McPherson Update
Hello guys. Mic wanted me to let you all know the following; I'm using excerpts from a personal email, and have Mic's descretion to do that:
Dear Andy,
After months of difficulty, where an employee of the State worked diligently to cause Peggy as much stress and grief as possible -- for example, forcing us to travel to Durango with all the associated expense and stress (that 45-mile trip is very hard on Peggy -- takes her three days to recover) to attempt to take a stress test (which Peggy's doctor assured everyone that Peggy could not even begin to complete) and other tests that could have been done in Cortez, we got the following e-mail notification from a different person, an employee of the SSA.
"Hi Mr. McPherson, Peggy's disability was awarded ... I will be available next Thursday afternoon say about 1:30 p.m. if I could call you then. We will need to update everything ... Happy New year! ...."
Perhaps my protests to State and Federal representatives helped resolve this matter more quickly.
I have no doubt that the proposed discussion will go well but we face another hurtle -- getting the SSA to back date the disability to the time that it actually began, so that some portion of the monumental medical expenses will be covered. Until we can do that -- if we can do that -- our financial existence will remain in jeopardy.
Meanwhile, we have survived but only through the generosity of friends and strangers who responded to your call. God bless one and all.
Sincerely Yours,
Mic
What Mic wanted me to emphasize is how very grateful he is to all who donated products for auction or funds to the Peggy McPherson Benefit Account, that has allowed the McPherson's to "hang in there" and not loose their house during this incredibly difficult time in their lives.
The way the firearms community came to this family's rescue is truly, truly amazing!
So, thanks to all of you who contributed, or just said prayers on their behalf. It was a beautiful piece of work, guys. You should be proud.
Thanks all.
Sincerely,
CowboyTutt

As someone who has been through this with his wife...
Mic - what you are seeing is par for the course. Follow through and don't sweat it too much. They ALWaYS back date the disability.
But they ALWAYS make you jump through their hoops first and it ALWAYS takes forever.

CowboyTutt,
Thank you for the update on Mic's situation. Glad to hear that his wife will be getting disability. Hopefully the MRSA she had is just a memory now.

Went thru this with the wife several years ago. Tests that were in towns 40 miles away when they could have be given locally ETC... Finally got an attorny that only handles S/S cases, and if he dosent win he dosent get paid. After a year of State B/S wife went before a S/S judge with the attorney. All the paper work was in order on his desk and he asked my wife several questions and made his decission on the spot. He went back 2 yrs to the date she had first filed and we received a nice healthy check.
We were lucky enoughto have the house paid for and only had the normal monthly bills. Iam retired military and had a part time job so that helped.
For any one else that has to go thru this I recommend you get a lawyer that onlyt handles S/S cases and gets no money until he /she wins. They are paid out of the settlement about the same time you get your money. There is a set amount they get (a percentage basis). Just for info my wife has Fibro. (and dont know how to spell the rest)

I have some familiarity with this area of law since I'm a Legal Assistant that works in health law. CowboyTutt or Mic can PM me, also. I can't make any promises, but maybe I offer some guidance if needed.Old Ironsights wrote:If he wants to email to me about the way we handled it - PM me.CowboyTutt wrote:Old Ironsights, I will pass that info on to Mic.
