Shipping a firarm to California ??

I sold a firearm via Gunbroker to a gentleman in California.
My local sporting goods store (Scheels) agreed to box it up and ship it to the FFL in California
who would recieve it for him (the buyer).
Doublechecking the procedure today Scheels NOW tells me they have to ship to their store in Reno who will then ship
to the destination FFL in (Redondo Beach) California.
Of course we are talking DOUBLE shipping and transfers fees now.
Using the search function on this forum I found the following post:

"I am FFL dealer in CA and yes starting July 1, 2008 firearms transfers between FFL dealers to or from a CA FFL must comply with the California Firearms License Check Program. Quote from CA DOJ letter: "As of July 1, 2008 CA Penal Code Section 12072(f)(1) prohibits all FFLs from shipping firearms to an FFL in CA unless, prior to delivery, the FFL intending to deliver, sell or transfer the firearm obtains a verification approval number from the CA DOJ Bureau of Firearms. This includes transfers that occur at gun shows. The verification approval number, which the Bureau of Fireams provides in a Firearms Shipment Approval Letter, confirms that the intended recipient of the firearm shipment is properly licensed and listed in the states database of persons/entities authorized to receive firearms shipments. If the intended CA FFL recipient is not listed in the states database, the transaction will result in a Do Not Ship letter, and it is a crime for the intended recipient to receive firearms(Pen.Code 12083(c)(1)."

All FFLs, in or out of CA who deal in CA must enroll in this program in order to receive approval letters over the internet or by FAX. There is no cost to this other than time and another form that must be kept for 3 years by the dealer. This does not apply to private party non FFL transfers from within or without of CA to a CA FFL. Bottom line - Is CA a gun owner friendly state? Come to your own conclusion.

As a private person (non FFL) can I ship it myself to the recieving FFL in California ??

If I can't ship it myself should I look for someone other than Scheels to ship for me? Are they giving me the runaround??

Does this firearm qualify as a C&R? 50 years or more old? If so, if the buyer has a c&r license then you could mail it to him direct...

Otherwise, it sounds like you need to just find an ffl dealer that has done the paperwork to sell to cali.

I personally would cancel the transaction based on the lack of being able to ship - or ask the guy if he will pay the extra shipping and transfer fee - otherwise, you have to cancel. Yes, you will take a negative on your gunbroker rating but you simply respond with the facts.

And then relist the item and say "sorry no california sales".

I know this las peeves our cali friends here, but hey - what are we to do?

You can send it yourself (as a non-licensee) provided the Ca FFL will accept it. The New Rule only applies to FFL's out of CA sending to a CA FFL and I think CA FFL to CA FFL as well.

I had not heard that. Most states, yes, but not cali - I guess it comes down to the CA ffl then. Good luck!

And I always put a caveate in my auctions about the rifle coming from a private citizen and that any extra fees are on the buyer - -so check in advance before bidding.... and the same if its a C&R... I actually had ffls on the receiving end not accept C&R transfers!

NKJ said it - you as an individual can send a firearm to an FFL in CA directly. Only FFL dealers have to register with the State (on both ends) and comply with the new rules that apply.

I'm not sure I understand the process here. AIUI, your Scheels isn't licensed to deal with CA FFLs and the Nevada Sheels is?

That's probably the case. Walmart doesn't have one FFL. Each Walmart has it's own. Sheels is the same and the other stores probably didn't bother to sign on with the Cal DOJ. If you look around the web gun auctions you will find many sellers that refuse to sign up or send guns to Cal.
It's not that big of a deal if everything goes well but I have had two so far that took several phone calls to straighted out. I now charge a Cal DOJ precess fee of $5. If it eventually smooths out I'll probably drop the fee.
